If you or somebody you care about has been injured in a car accident in the Henderson area, there may be various types of compensation available for your claim. There is no set amount awarded in these cases, but the team at DiMarco Araujo Montevideo is regularly able to help clients recover the following:
It is important to distinguish between insurance claims and lawsuits in these situations. Most insurance carriers require that the accident be reported as soon as possible after the incident occurs. This is usually within a day or two. Failing to report the incident to the insurance company in a timely manner could result in a claim denial or delay.
However, Nevada does have a two-year statute of limitations in place for car accident cases. This means that car accident injury victims have a two-year window with which to file a lawsuit against an alleged negligent party, or they will not be able to recover any compensation for their losses. This two-year clock starts running the day the accident occurs.
Many car accident victims are led to believe that they cannot recover compensation if they were partially at fault for the incident. This is not true. Under Section 41.141 of the Nevada Revised Statutes (NRS), we can see that this state operates under a “modified comparative negligence” system. This means that a car accident injury victim can recover compensation if they are 50% or less at fault for the incident. However, the amount of compensation they receive will be reduced based on their percentage of fault.
For example, if a car accident victim sustained $100,000 worth of damages, but a jury determines that the victim was 20% responsible for the incident because of a busted taillight, then they would receive a reduced compensation of $80,000.
Any car accident victim that is more than 50% responsible for the incident will not be able to recover compensation, per Nevada modified comparative negligence law.
If you have been the victim of an accident caused by another party, please be aware that the other party may try to place some or all of the blame on you for the incident in an effort to avoid paying any compensation for the claim.
Hit and run accidents are an unfortunate occurrence, and it is rare that these at-fault drivers are apprehended and brought to justice. Drivers injured in a hit-and-run accident may be able to turn to their uninsured motorist coverage to recover compensation. This type of coverage is not required under Nevada’s auto insurance laws, but it is highly recommended.
Uninsured and underinsured motorist coverage can provide great benefits to drivers who are injured by uninsured motorists. In the event a hit and run driver is apprehended, it may be possible to recover compensation by filing a personal injury lawsuit against them. However, it is unlikely that these drivers will have the assets to be able to cover any damages awarded by a jury. Underinsured motorist coverage is beneficial if a person is injured by a driver with insurance limits that are inadequate to cover the total expenses. Underinsured motorist coverage will kick in to pick up the difference.
